1. Introduction

These Terms & Conditions govern the use of the Aurelia Blue Experiences website and the booking and participation in any sailing voyage, sailing holiday, expedition, or related service offered by Aurelia Blue Experiences (“we”, “us”, “our”).

By making a booking, submitting a reservation request, or participating in one of our voyages, you agree to be bound by these Terms & Conditions.

2. Nature of Our Voyages

Aurelia Blue Experiences offers shared voyages, sailing holidays, offshore passages, expeditions, and other sailing-related experiences aboard privately owned yachts.

Our voyages are not cruise ship holidays, all-inclusive resorts, or commercial passenger transport services.

Sailing involves changing weather conditions, route adjustments, and active life at sea. Flexibility and a positive attitude are essential parts of the experience.

3. Booking and Reservation

A booking is considered confirmed only after:

• Acceptance by Aurelia Blue Experiences;
• Receipt of the required deposit or payment;
• Confirmation sent by us.

We reserve the right to decline any booking request without providing a reason.

Guests are responsible for ensuring that all information provided during the booking process is accurate and complete.

4. Payments, Cancellations and Changes

4.1 Payment Terms

The following payment schedule applies:

• Deposit: 50% of the voyage price, payable within seven (7) days after conclusion of the booking agreement.

• Final Payment: The remaining balance, including any agreed provisioning or catering charges, must be received by Aurelia Blue Experiences no later than fourteen (14) days before the scheduled departure date.

The onboard cash fund (“Board Cash”) and any security deposit may be paid in advance. If paid by bank transfer, the funds must be received by Aurelia Blue Experiences no later than one (1) day before departure. Alternatively, these amounts may be paid in cash on the guest’s arrival day.

By prior agreement and subject to availability, guests may arrive on board before the scheduled embarkation date or remain on board after the official end of the voyage.

For any such additional overnight stay, the agreed on-board food package will continue to apply. In addition, an accommodation charge of EUR 35 per person per night will be charged.

Additional overnight stays do not extend the booked voyage and do not create any entitlement to additional sailing days, route changes, itinerary services, or other travel services beyond those expressly agreed.

Any banking fees, transfer charges, or currency conversion costs are the responsibility of the guest unless otherwise agreed.

Failure to make payments by the due dates constitutes a material breach of contract. Aurelia Blue Experiences reserves the right to withdraw from the agreement and cancel the booking without further notice. In such case, the cancellation terms set out below shall apply.

4.2 Cancellation by the Guest

All cancellations must be made in writing.

The following cancellation charges apply, calculated on the voyage price excluding Board Cash, provisioning costs, catering costs and any refundable security deposit:

• More than ninety (90) days before departure: 25% of the voyage price.

• From ninety (90) days up to thirty-one (31) days before departure: 50% of the voyage price.

• Thirty (30) days or less before departure, failure to commence the voyage, or no-show: 90% of the voyage price.

4.3 Rebooking

Subject to availability and Aurelia Blue Experiences’ approval, a guest may request a transfer to another voyage date more than ninety (90) days before departure.

An administrative rebooking fee of 10% of the original voyage price shall apply.

Aurelia Blue Experiences is under no obligation to offer an alternative voyage date.

4.4 Replacement Guest

Up to thirty (30) days before departure, the guest may nominate a replacement person to take their place.

The replacement guest is subject to approval by Aurelia Blue Experiences at its sole discretion. An administration fee of EUR 80 shall apply for each approved replacement.

The original guest remains liable for all payments and obligations under the booking agreement until the replacement guest has been formally accepted and all outstanding amounts have been paid.

4.5 Duty to Mitigate Damages

In the event of a cancellation received in due time, Aurelia Blue Experiences will make reasonable efforts, but is under no obligation, to reduce losses by seeking a suitable replacement guest.

The guest acknowledges that a cancellation causes administrative and operational expenses, including but not limited to booking administration, communication with the cancelling guest, processing of the cancellation, updating availability, marketing activities, advertising expenses, and the time required to secure a replacement booking.

Accordingly, the cancellation charges set out in these Terms and Conditions represent a reasonable estimate of the losses and expenses incurred by Aurelia Blue Experiences and shall remain payable even if a replacement guest is subsequently found.

The cancellation fees constitute agreed liquidated damages and are not a penalty.

Where Aurelia Blue Experiences successfully resells the cancelled berth or cabin, any net financial benefit actually received may, at Aurelia Blue Experiences’ sole discretion, be taken into account when determining whether any reduction of cancellation charges is appropriate.

Aurelia Blue Experiences reserves the right to offer the cancelled berth, cabin or voyage at a reduced last-minute price. Any discount, commission, advertising cost, administrative expense, payment processing fee, or other cost incurred in obtaining a replacement booking shall be deducted before calculating any possible reduction of cancellation charges.

We strongly recommend purchasing comprehensive travel insurance that includes trip cancellation coverage.

5. Changes and Cancellations by Aurelia Blue Experiences

We reserve the right to modify, postpone, or cancel a voyage if necessary due to:

• Weather conditions
• Safety concerns
• Mechanical issues
• Government restrictions
• Port closures
• Force majeure events
• Insufficient participation
• Any circumstances beyond our reasonable control

If a voyage is cancelled by us before departure, guests may be offered:

• A rescheduled voyage;
• A travel credit;
• A refund, subject to applicable circumstances.

We shall not be liable for additional expenses such as flights, hotels, transfers, visas, or other travel arrangements made by guests.

6. Sailing Routes and Itineraries

All itineraries are indicative only.

The skipper has sole authority to modify routes, destinations, departure times, anchorages, and schedules based on:

• Safety considerations
• Weather conditions
• Sea conditions
• Technical considerations
• Operational requirements

No specific route, destination, anchorage, or sightseeing opportunity is guaranteed.

7. Participation and Conduct On Board

Guests agree to behave responsibly and respectfully toward:

• Crew members

• Other guests

• Local communities

• The marine environment

The skipper’s decisions regarding safety and vessel operation are final.

Guests must comply with all reasonable instructions provided by the skipper or crew.

Aurelia Blue Experiences reserves the right to terminate participation without refund if a guest:

• Endangers the safety of others;

• Is excessively intoxicated;

• Uses illegal substances;

• Behaves aggressively or disruptively;

• Fails to comply with safety instructions.

8. Active Participation & Comfort Package

Life aboard a sailing yacht is a shared experience. Unlike a hotel or cruise ship, certain daily activities are part of normal life at sea and contribute to the smooth operation of the vessel.

Depending on the voyage, guests may be invited or required to assist with basic onboard tasks such as:

• Handling mooring lines

• Assisting during docking and departure procedures

• Fenders and mooring preparation

• Simple sailing activities

• General cooperation during daily onboard operations

For offshore passages, expedition voyages, and designated sailing-focused voyages, active participation may be mandatory. Such requirements will always be clearly stated in the individual voyage description.

For guests who prefer a more relaxed holiday experience and do not wish to participate in routine onboard operations, Aurelia Blue Experiences may offer an optional Comfort Package.

Under the Comfort Package, the crew assumes responsibility for routine operational tasks normally shared with guests. As this requires additional service and workload, an additional fee applies.

The Comfort Package is mandatory for guests who are unable to safely perform routine onboard tasks due to physical limitations, medical conditions, allergies, injuries, reduced mobility, or other circumstances that prevent participation. This includes, but is not limited to, situations such as allergies to cleaning products or dishwashing detergents, chronic health conditions, temporary injuries, or other restrictions affecting onboard duties.

Guests are required to disclose any such limitations prior to booking. Aurelia Blue Experiences reserves the right to determine whether the Comfort Package is necessary to ensure the safe and smooth operation of the vessel and the comfort of all guests on board.

The availability, scope, and pricing of the Comfort Package may vary depending on the voyage and must be agreed upon prior to departure.

Regardless of participation level or the booking of a Comfort Package, all guests must comply with safety instructions issued by the skipper or crew at all times.

In situations involving safety, emergencies, docking, anchoring, mooring operations, or vessel handling, all persons on board may be required to assist if reasonably requested by the skipper or crew.

The skipper retains full authority regarding the safe operation of the vessel at all times.

9. Health and Fitness

Guests are responsible for ensuring they are medically fit to participate in the voyage.

Any relevant medical conditions, allergies, dietary requirements, mobility limitations, or medications should be disclosed prior to departure.

Participation is at the guest’s own risk.

The skipper reserves the right to refuse participation where safety concerns exist.

10. Travel Documents

Guests are responsible for ensuring they have all required documents before the voyage begins, including:

• Valid passport
• Any visas required for arrival at the embarkation country
• Compliance with entry requirements for joining the voyage
• Required vaccinations or health documentation
• Customs and immigration requirements applicable before embarkation

During the voyage, Aurelia Blue Experiences will coordinate and assist with official clearance procedures, immigration formalities, and entry permits required for the planned itinerary. Guests remain responsible for providing valid personal documents and any information required by the authorities.

Aurelia Blue Experiences cannot be held responsible for denied boarding, denied entry, deportation, missed travel connections, or any consequences resulting from incomplete, expired, or invalid travel documents or from a guest’s failure to meet official entry requirements.

We are happy to provide up-to-date guidance on the travel requirements for our planned itinerary. However, the final responsibility for carrying valid travel documents and meeting all official entry requirements remains with each guest.

11. Travel Insurance

Comprehensive travel insurance is strongly recommended.

Insurance should ideally cover:

• Medical expenses

• Emergency evacuation

• Personal liability

• Trip cancellation

• Travel delays

• Lost luggage

Guests remain responsible for any costs not covered by their insurance provider.

12. Liability

Sailing and water-based activities involve inherent risks.

To the maximum extent permitted by law, Aurelia Blue Experiences, its owners, crew, contractors, and representatives shall not be liable for:

• Personal injury

• Illness

• Loss of personal property

• Theft

• Travel disruptions

• Weather-related changes

• Delays

• Missed connections

• Indirect or consequential losses

Nothing in these Terms excludes liability where exclusion is prohibited by applicable law.

14. Photography and Media

Photographs and videos may be taken during voyages.

Unless a guest specifically requests otherwise in writing, Aurelia Blue Experiences may use such material for:

• Website content

• Social media

• Marketing materials

• Promotional activities

Guests may request removal of identifiable images by contacting us.

15. Privacy

Personal information is processed in accordance with our Privacy Policy.

Please refer to our Privacy Policy for detailed information regarding data collection, storage, and processing.

16. Force Majeure

Aurelia Blue Experiences shall not be liable for failure to perform obligations resulting from events beyond reasonable control, including but not limited to:

• Natural disasters

• Hurricanes

• Severe weather

• Pandemics

• Government actions

• Armed conflict

• Port closures

• Transportation disruptions

17. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Malta.

Any dispute arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the competent courts of Malta.
